Adaptable Travel Limited (‘Adaptable Travel’, ‘we’, ‘our’, ‘us’) may reach out to social media users to request permission to feature selected content across our website, social media channels, and promotional materials. If you are reading this, we are requesting your consent to use your social media content (‘User Content’ or ‘Content’) for these purposes.

By allowing us to use your social media content (including photos and videos) by replying with the hashtag #GoAdaptable, you agree to these Terms of Use, along with the terms and conditions of the applicable social platform (e.g., X, Facebook, Instagram, LinkedIn, YouTube).

Adaptable Travel may collect and transmit your content, including photos, text, graphics, audio, video, location information, comments, and other materials, to its website (adaptabletravel.com), social media channels (e.g., X, Facebook, Instagram, LinkedIn, YouTube), promotional materials, surveys, and other properties (collectively, ‘Properties’), for use in connection with our business, including marketing, promotional, and other customer-related activities (‘Activities’).

You grant Adaptable Travel and its affiliates, agents, licensees, sublicensees, contractors, successors, legal representatives, assigns, and third-party service providers (collectively, the ‘Licensed Parties’) a worldwide, perpetual, irrevocable, royalty-free, fully-paid, non-confidential, non-exclusive, transferable, sublicensable right to use, store, and/or copy your content for any purpose, including but not limited to online and offline promotional materials, social media pages, and other marketing initiatives, in any media format, whether now known or developed in the future.

The Licensed Parties may display, perform publicly, reproduce, distribute, transmit, create derivative works from, combine with other materials, modify, and make publicly accessible the content in any way, at their sole discretion, without any obligation to you.

You further grant the Licensed Parties permission to use your username, real name, image, likeness, description, location, or other identifying information, including but not limited to your voice, in association with any use of your User Content.

By agreeing to allow the use of your Content, you confirm, warrant, and represent that:

1. You are at least 18 years old;
2. You hold all rights to the Content, or have obtained appropriate rights and permissions from anyone with an interest in the Content;
3. You bear full responsibility for the Content;
4. The Licensed Parties’ use of your Content as described herein does not infringe on any third-party rights (including copyright, trademark, privacy, or publicity rights) or violate any law;
5. To the extent allowed by law, you waive any “moral rights” or other rights with respect to attribution or integrity of the Content; and
6. The Content does not contain libelous, defamatory, obscene, or otherwise unlawful material, nor any material that discriminates or is offensive on the grounds of race, religion, sex, sexual orientation, age, or disability.

The Licensed Parties reserve the right to remove any Content from the Site or Properties at their discretion. If you believe any content displayed on the Site or Properties infringes on someone’s rights, please contact us.

The Licensed Parties are not obligated to keep any information you provide confidential, including your identity, and may disclose such information in response to a claim of infringement or as otherwise required by applicable privacy policies.

By using our Site and/or Properties, you consent to the Licensed Parties’ collection and use of your personal information for these purposes. If you do not agree to this use, please refrain from providing your personal information. Your personal information may be transferred outside your country of residence for processing by the Licensed Parties or third-party providers. By providing your information, you consent to these terms, Adaptable Travel’s Privacy Policy, and applicable data protection laws.

You agree to release, discharge, and hold harmless the Licensed Parties and anyone acting on their behalf from any liability associated with the use of your Content.

These Terms of Use are personal to you and may not be assigned or transferred by you without prior written consent from Adaptable Travel, and any attempt to do so will be void.

Adaptable Travel reserves the right to modify these Terms of Use at any time by posting revised Terms of Use. Please review these Terms whenever you grant permission to use your Content.

Failure by Adaptable Travel to exercise or enforce any legal right or remedy does not constitute a waiver of that right.

If any provision of these Terms is deemed unenforceable by a court, that provision will be removed, but the rest of the Terms will remain in effect.

These Terms of Use are governed by English law, and you agree to submit to the exclusive jurisdiction of the English courts.
